Terms of Service
Draft under legal review. Items in [square brackets] are still being decided. Last updated November 3, 2026 (version 2026-11-03-3).
1. Who's who
- Fanvas, "we" or "us": [legal company name], a company registered in [country of registration, to be decided] at [address], which runs the Fanvas website and apps worldwide (the "Service").
- You: anyone who uses the Service.
- Fan: someone who watches videos, subscribes, tips or buys pay-to-watch videos.
- Creator: someone who posts videos and earns from fans.
- Manager: an agency or individual (including a "Fanvas Scout") that a creator chooses to work with, and that receives an agreed share of the creator's earnings.
- Chatter: a person a manager invites to answer fans on a creator's behalf.
- Creator's pie: what is left of a fan's payment after payment fees and Fanvas's 10%.
One person can hold more than one role, for example a creator who is also a fan. The parts of these terms for each role apply when you act in that role.
2. Accepting these terms
By creating an account or using the Service, you agree to these terms, our Privacy Policy and our Community Rules. If you don't agree, don't use the Service.
If you use the Service for a business, such as a management agency, you confirm you are allowed to accept these terms for that business.
3. Eligibility and accounts
- Age: you give your date of birth when you sign up. Creators, managers and chatters must be at least 18. Anyone [13] or older can make a fan account and watch free videos. Subscribing, buying, tipping and messaging creators are for people 18 and over [or the age of majority where you live, lawyer to confirm].
- True details: when you sign up you confirm that your details, including your date of birth, are true and about you. If someone gives false details or uses another person's identity, account or payment method (for example a child using a parent's card), they and the account holder are responsible, not Fanvas. We may close accounts with false details.
- Roles: you can sign up as a fan or a creator. Agencies apply and are approved by Fanvas. Chatters join by a manager's invitation.
- Accurate details: give true information and keep it up to date. Creators and managers must give their legal name for payouts.
- Names and handles: your @handle can't be changed once chosen. You can change your display name once every 30 days; fans see your previous name for two weeks, and a verified creator is re-checked.
- One person, one account, unless we agree otherwise in writing. Don't share your login.
- Security: keep your password safe and tell us right away if you think someone else has accessed your account.
4. Fanvas is not part of dealings between users
Fanvas provides a platform: it hosts videos, collects fan payments, splits and pays them out using the terms users set, and provides tools to communicate. Everything between users is between those users.
- Not a party. Fanvas is not a party to any agreement, arrangement or dispute between fans, creators, managers, chatters, brands or anyone else, written or unwritten, inside or outside Fanvas. We don't draft, review, sign, store, supervise or enforce those agreements.
- The split is mechanical. When a creator and manager accept a share and length in Fanvas, Fanvas applies that split automatically. That is a setting the two of them chose, not a decision by Fanvas. The same goes for the dispute hold in section 9.
- No duty to step in. Fanvas has no obligation to monitor, mediate or resolve anything between users. We may act (for example, removing illegal content or suspending an account), but acting once doesn't create a duty to act again.
- Release. To the fullest extent the law allows, you release Fanvas, its owners, staff and partners from all claims, losses and damages arising from your dealings with other users, including a manager's or creator's performance or conduct, brand deals, and anything agreed outside Fanvas.
- Brand deals and outside income are yours. Fanvas takes no share of what a brand pays a creator, or of earnings on other platforms.
- Independent users. Creators, managers and chatters are not Fanvas's employees, agents or partners. Each is responsible for their own work, promises, conduct and taxes.
- Verification is limited. A ✓ means Fanvas checked an ID (creators) or business documents (agencies). It doesn't mean we vouch for anyone's work. Meet a manager and check their background before accepting an offer.
- Collecting payments. When a fan pays, the payment is for the creator's content. Fanvas collects it on the creator's behalf and passes it on, less fees and our share. [Lawyer to confirm this framing with the payment provider.]
5. Content rules
Every video is reviewed by Fanvas before it goes live. Our Community Rules give the full detail; in short, you may not post or send sexual or adult content, anything that sexualises minors, content you don't have rights to, violence, threats, harassment or hate, scams or spam, or someone else's private information.
Review and takedowns: we may approve, send back with a reason, or remove any content, and may limit or close accounts that break these rules. Where we can, we tell you why.
Reports: anyone can report a video, a message, a creator or a person. When a creator's video or page is reported, the creator and their manager are told right away (never who reported it) and told the outcome. Fans are told only if action is taken.
Sponsored content: if a brand paid you or gave you something for a video, mark it "Sponsored". [Lawyer to confirm.]
6. Who owns content
- Creators keep ownership of their videos and everything they post.
- You give Fanvas a licence to host, store, copy, format, display and stream your content on the Service, and to make previews you approve. This licence is worldwide and royalty-free, and ends when the content is removed, except for copies we must keep by law or for an open dispute.
- Fans get a personal, non-transferable licence to watch content they have access to, on the Service only. Fans may not download, record, copy, share or resell content.
- Copyright complaints: tell us at support@fanvas.tv with details. We remove infringing content and may close repeat infringers' accounts.
7. For fans
- Free videos can be watched by anyone.
- Subscriptions give access to a creator's members-only videos for one month at the price shown before you pay, and renew automatically each month until you cancel. You can cancel any time and keep access until the end of the month you paid for.
- Pay-to-watch videos are bought once and stay yours for as long as the video is on Fanvas, even without a subscription. Subscribers may get a discount the creator sets.
- Tips are one-time gifts to a creator. A tip is not an order: it doesn't buy a video, a greeting or anything else.
- Videos sent in messages: a creator's team may send you a video in a chat, sometimes pay-to-unlock at the price shown. Unlocking it is the same as buying a pay-to-watch video, with no subscriber discount.
- No refunds. Subscriptions, pay-to-watch videos and tips can't be refunded once paid, except where the law requires it or if something didn't work on our side. You are asked to confirm this before paying. [Lawyer to confirm against consumer law in key markets, including the EU right of withdrawal for digital content.]
- Price changes: creators set their own prices ($1 minimum). If a creator raises their subscription price, it applies to new subscribers; [existing subscribers are told before any change at renewal].
- When a creator leaves or is suspended, you are notified. If they leave, your subscription stops renewing and you keep access until your paid month ends. If they are suspended, your subscription is paused and the days are added back if they return.
- Who charges you: Fanvas charges you and appears on your receipt and statement. Fanvas then pays the creator under its creator terms (see section 8).
- Payment methods are handled by our payment provider [name]. Their terms also apply.
8. For creators
How each payment splits, in this order:
- Payment fees charged by the payment provider (they vary by payment method; about 3.5% on average) come off first.
- Fanvas takes 10% of what remains.
- What's left is your pie (100%).
- If you have a manager, they receive their agreed % of your pie.
- You keep the rest.
Example: a fan pays $10.00 and you have a 20% manager. Fees $0.65, Fanvas $0.94, your pie $8.41, manager $1.68, you $6.73.
- Prices: you set your subscription price and each pay-to-watch price ($1 minimum, no maximum), and the discount your subscribers get on pay-to-watch videos.
- Payouts: once a month, on the last day of the month, when your balance is $50 or more, to the e-wallet, bank or payout account you provide in your legal name.
- Identity check: to get the ✓, and before your first payout, we confirm you are a real person aged 18 or over, using a government ID and a selfie.
- Holds and deductions: we may hold or deduct amounts for refunds, chargebacks, suspected fraud, or a dispute under section 9.
- Records we keep: we keep a record of which version of these terms you accepted and when, a log of decisions Fanvas makes about content and accounts, and, for [180 days], hidden copies of removed or reported content, so we can show what happened if a user, the authorities or a court ask. [Lawyer to confirm retention.]
- Statements: you can download your earnings for any month or year as a PDF or CSV. They are a record of what you earned on Fanvas, not tax advice.
- Wellbeing: creators can show fans a "taking a break" note, and can contact an independent wellbeing partner listed in their dashboard. That partner is not part of Fanvas, Fanvas doesn't see those conversations, and it is not a medical or emergency service.
- Taxes: you are responsible for tax on your earnings. Where the law requires, we will collect your tax details and report your earnings. [Lawyer to confirm.]
- Your other income is yours: brand deals, sponsorships and earnings on other platforms are not shared with Fanvas.
9. Managers and agreements
- A manager (an approved agency or a Fanvas Scout) sends an offer through Fanvas, stating their share (any % of the creator's pie) and the length (6, 12 or 24 months).
- The creator and manager can talk through Business messages. Fanvas strongly encourages meeting first and agreeing in writing, between themselves, what the manager will do.
- The creator accepts or declines. Before accepting, Fanvas shows the key terms and asks the creator to confirm.
- Once accepted, the manager's share is taken automatically from each payment for the agreed length.
- A creator can have one active manager at a time.
- The share and length are fixed. A change takes effect only when both approve it in Fanvas.
- What the manager does for the creator is between them. Fanvas does not supervise or guarantee it.
- Disputes: either side can raise a dispute in Fanvas. Payouts affected are held for up to 180 days while the two settle it; if not settled, the held money is released on the last terms both approved. Fanvas does not decide who is right.
- Ending early: only if both agree in Fanvas, if either account is closed, or if Fanvas suspends either party for a serious breach.
- Manager responsibilities: act honestly and in the creator's interest, don't pressure creators, and take responsibility for your chatters.
9a. Team payouts
- A creator's manager can choose to share part of their own manager share with people on their team (for example an editor or assistant), by adding them in Fanvas. Creators who want to run their own team this way apply as a manager, with a separate account, and pass manager verification.
- The person giving the share decides who receives it and how much, and can change or end it at any time; it stops applying from that moment. A person receiving a share can leave at any time.
- These arrangements are between the people involved. Fanvas is not a party to them, doesn't check or enforce any promise behind them, and only calculates and pays the amounts set. Disputes about them are for the people involved to settle.
- People receiving a share must be 18 or older, must have verified their identity with Fanvas first, and are responsible for their own taxes.
10. Chatters
- Chatters join only by a manager's invitation and answer fan messages only for the creators they're assigned.
- Every chatter reply shows a TEAM badge with their first name.
- Chatters must not pretend to be the creator, ask fans for money or personal details, or share anything from the inbox outside Fanvas.
- Chatters can leave a team at any time. The manager is responsible for their chatters.
11. Messages and conduct
- Only subscribers aged 18 and over can message a creator. Creators and their team can block fans.
- Photos and videos in messages are checked by Fanvas before they're delivered, like every video upload. Messages to all subscribers are limited to 3 a week.
- Comments under videos are public, for people 18 and over who can watch the video. Creators can switch comments off, and they, their team and Fanvas can remove comments.
- Greetings and personal requests are between you and the creator's team. Fanvas doesn't sell them and isn't part of any promise made.
- Messages show who wrote them: CREATOR, TEAM, MANAGER or FANVAS.
- Fanvas does not read private conversations it isn't part of, except when a message is reported, when a dispute is raised, when someone invites us in, or when the law requires it.
- Everyone must be respectful; not harass, threaten, scam or impersonate anyone; not send spam; not ask anyone under 18 for personal details or meetings; not share someone else's private information.
12. Privacy
Our Privacy Policy explains what personal data we collect, why, who we share it with, how long we keep it, and your rights. We don't sell your personal data.
13. Closing your account
- Grace period: when you close your account, it closes for good after 30 days. Until then you can keep it from Account settings.
- Your subscriptions stop renewing; you keep access until each paid month ends.
- Creators: subscribers are notified, nothing renews, and fans keep access until their paid month ends; the account closes after the last paid month ends if that is later than 30 days. Any manager agreement ends when the account closes.
- Managers: creators are notified, agreements end when the account closes, and chatters lose access.
- Empty your wallet first. Any balance is paid out before closing; the $50 minimum is waived. Fanvas never keeps your money. A creator's manager is asked to confirm the final payout; if they don't respond within 7 days it is paid on the agreed terms.
- Money on hold (an open dispute) must be settled before an account can close.
- After closing, personal data is erased, messages show as "Deleted user", and we keep only records the law requires for [X years].
14. Suspension by Fanvas
We may warn, limit, suspend or close an account that breaks these terms or the law, puts others at risk, or is involved in fraud. We tell you why. While suspended you can still log in to see the reason and appeal; a creator's manager can appeal for them. A suspended creator's page and videos are hidden and their fans' subscriptions are paused (the days are added back if the suspension is lifted). Money earned legitimately is still paid out, minus refunds, chargebacks or proven fraud, unless the law requires us to hold it.
15. Disclaimers and limits of liability
- The Service is provided "as is". We work to keep it running and safe but can't promise it will always be available or error-free.
- We are not responsible for what users say or do, for agreements between users, or for content we did not create.
- To the extent the law allows, our total liability to you is limited to [the amount Fanvas received from or paid to you in the 12 months before the claim], and we are not liable for indirect losses such as lost profits.
- Indemnity: if someone makes a claim against Fanvas because of your content, your conduct, your breach of these terms, or your dealings with another user, you agree to cover Fanvas's resulting losses and reasonable legal costs, to the extent the law allows.
- Nothing in these terms limits rights you have under consumer protection law that can't be waived.
16. Disputes and governing law
- These terms apply wherever you use Fanvas.
- Disputes between users are theirs to settle (see sections 4 and 9).
- Disputes with Fanvas: contact us first at support@fanvas.tv; we'll try to resolve it within [30] days.
- Governing law: the laws of [country of registration, to be decided], with the courts of [city].
- Your local rights: if the law where you live gives you rights or a court you can't contractually give up, those still apply.
17. Changes to these terms
We may update these terms. For important changes, we'll notify you at least [15] days before they take effect. If you don't agree, you can close your account.
